1. About These Terms

These Terms of Use govern access to the AG Properties website, online reservation tools, and customer portal, collectively referred to as our “Online Services.”

By accessing or using our Online Services, you agree to these Terms. If you do not agree, please do not use the Online Services.

2. Relationship to Your Rental Agreement

These Terms govern use of our Online Services. Your signed rental agreement governs your storage rental, including payment obligations, permitted storage, insurance requirements, property access, renewals, cancellation, move-out, and any applicable fees.

If these Terms conflict with your signed rental agreement regarding your rental, the signed rental agreement controls.

3. Eligibility and Accurate Information

You must be at least 18 years old and legally able to enter into an agreement to submit a rental application or establish a customer account.

You agree to provide accurate and current contact, vehicle, trailer, billing, and other requested information. If you act on behalf of a business or another person, you must have authority to do so.

Please notify us when information relevant to your rental changes.

4. Availability and Reservation Requests

Our online map and availability information are provided for convenience. Space availability, descriptions, dimensions, and prices are subject to verification.

Submitting an inquiry or reservation request does not, by itself, guarantee a space or authorize you to enter the property or begin storing an item.

A rental becomes effective according to the approval, signing, payment, and other requirements stated in your rental agreement and confirmation from AG Properties.

5. Customer Accounts and Property Access

You are responsible for protecting your login credentials, verification codes, and any assigned gate or access credentials.

Do not share account or property access with unauthorized persons. Notify us promptly if you believe your account or access credentials have been compromised.

An online account does not independently grant permission to enter the property. Property access is governed by your rental agreement and authorization from AG Properties.

We may restrict online account access when reasonably necessary to address unauthorized use, fraud, security concerns, or violations of these Terms. Any restriction of physical property access remains subject to your rental agreement and applicable law.

6. Pricing, Billing, and Payments

Your approved rental agreement and any agreed written amendments determine your rental rate, billing frequency, payment due dates, and applicable fees.

Website prices are informational until confirmed as part of your rental. Monthly and annual options may have different terms.

Submitting payment information does not automatically authorize recurring payments. Any recurring payment arrangement requires separate authorization.

Renewal, cancellation, refund, and move-out terms are governed by your rental agreement. A portal request to renew or move out must be completed in accordance with that agreement and any required confirmation from AG Properties.

If you believe an invoice or payment record is incorrect, contact us promptly at rental@ag-properties.com.

7. Electronic Documents and Communications

Our Online Services may allow you to receive documents, submit forms, and sign agreements electronically. Any required consent to electronic records or signatures will be provided through the applicable signing or consent process.

We may send service-related communications about your inquiries, account verification, rental, invoices, payments, renewal, move-out, or property access.

Electronic signing and delivery services may be provided by third parties and may also be subject to their terms.

8. Acceptable Use

You agree not to:

• Access another customer’s account or information without authorization.

• Submit fraudulent, misleading, unlawful, or malicious information.

• Interfere with the operation or security of our Online Services.

• Upload malware or attempt to bypass authentication or access controls.

• Use automated tools to extract customer information or disrupt the Online Services.

• Use our Online Services for unlawful purposes.

9. Website Content

AG Properties owns or has permission to use the content presented through its Online Services, including branding, text, maps, graphics, and layouts.

You may use this content for personal purposes related to evaluating or managing an AG Properties rental. Other reproduction, distribution, or commercial use requires permission, except as otherwise allowed by law.

10. Third-Party Services

Our Online Services may link to or incorporate third-party services for forms, electronic signatures, hosting, accounting, or payments.

Those providers may have their own terms and privacy policies. AG Properties does not control independently operated third-party websites or services.

11. Service Availability and Errors

We make reasonable efforts to keep our Online Services accurate and available, but interruptions, delays, or errors may occur.

To the extent permitted by law, the Online Services are provided “as is” and “as available,” without warranties of uninterrupted access, complete accuracy, or fitness for a particular purpose.

Please contact us if an online error affects your account or rental. An outage does not automatically change your rental obligations, and any applicable legal rights remain in effect.

12. Limitation of Liability

To the extent permitted by law, AG Properties is not liable for indirect, incidental, special, or consequential damages arising from use of, or inability to use, the Online Services.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limits rights or remedies that cannot lawfully be waived.

Responsibility for stored vehicles, trailers, boats, or other property is addressed in your signed rental agreement.

13. Privacy

Our Privacy Policy explains how we collect, use, and disclose personal information in connection with our business and Online Services.

14. Changes to These Terms

We may update these Terms and will post the revised version with a new effective date. For material changes, we will provide additional notice when required by law.

Changes to these Terms do not independently amend an existing signed rental agreement. Amendments to that agreement must follow its applicable requirements.

15. Governing Law

These Terms are governed by Nebraska law, without regard to conflict-of-law rules, except where applicable law requires otherwise.
